Terms of service

These terms apply when you use TicketCounts.io. They cover your account, plans and billing, the ticketing accounts you connect and the reports you send.

Last updated

The short version

  • You must be 18 or older. Keep your login to yourself.
  • The Free plan runs 1 active report. New accounts get 14 days of Pro with no card, and nothing is charged when the trial ends.
  • Paid plans renew every month until you cancel. Cancel any time in Dashboard > Billing; you keep your plan until the end of the paid month.
  • Only send reports to people who expect them. Every report email has an unsubscribe link, and mail apps that support it show a one-click unsubscribe button.
  • Counts are what your ticketing platform reports at the time of each send. Check them before you settle a show.

This summary is for convenience. The terms below are what apply.

1.Who we are and this agreement

TicketCounts.io is a product of Elektronic Group Inc. In these terms, “we”, “us” and “our” mean Elektronic Group Inc., and “you” means the person or organization using TicketCounts.io (the “service”).

By creating an account, subscribing or otherwise using the service, you agree to these terms and to our Privacy Policy. If you use the service for an organization, you confirm that you may accept these terms for it. If you do not agree, do not use the service.

2.The service

TicketCounts.io connects to Eventbrite and Universe and emails scheduled, branded ticket-count reports to promoters, venues, artists and booking agents.

When you connect an account, the service reads the events you can access and, for each report, the number of tickets sold per ticket type (with paid and free totals) and the capacity when the platform provides it. It does not read your buyers’ names, email addresses or orders.

Reports go out on the days and at the local time you choose (daily, weekly or on chosen weekdays). We work to send every report on time, but a send can be delayed, for example when a ticketing platform or our email provider is unavailable. A report that cannot be sent within 6 hours of its scheduled time is skipped, and the next one goes out as scheduled. A report that keeps failing is paused, and we tell you. When an event ends or is canceled on the platform, its report is paused.

The service works with Eventbrite and Universe today, and with no other ticketing platform. Our integrations page lists what is available. No other platform is part of the service unless and until we announce that it is available, and we make no commitment to add one.

Reports are for information. Counts are what the platform reports at the time of each send. Check them against your ticketing platform before you settle a show or make financial decisions.

3.Your account

  • You must be at least 18 years old to create an account or use the service.
  • Give accurate information and keep your email address current, because we send billing and service notices to it.
  • Keep your password and sign-in links private. Do not share your login; each account is for one person.
  • You are responsible for what happens in your account. Tell us at once at support@elektronicgroup.com if you think someone else has access.

4.Plans, trial and billing

4.1 Plans and prices

Our plans, their monthly prices in US dollars and their limits are listed on the pricing page. Each plan allows a number of active event reports and a number of recipients per report. Paused reports do not count toward the limit.

We may change our prices. We will email you at least 30 days before a new price applies to your subscription, and it applies from your first renewal after that notice period. If you do not want to pay the new price, cancel before it applies.

4.2 Free plan and trial

The Free plan costs nothing and includes 1 active event report with up to 2 recipients. Reports on it use the TicketCounts.io header and footer.

Every new account starts with 14 days of Pro at no charge. You do not need a payment card, and the trial never turns into a paid subscription on its own. We email you 3 days before the trial ends and when it ends. If you have not chosen a paid plan by then, your account moves to the Free plan: reports beyond its limit are paused (your oldest active report keeps running), your logo is replaced by the TicketCounts.io header, and the footer is shown again. Recipients above the Free plan’s limit of 2 per report stay on the report but are not sent to until you choose a plan that allows them; the first ones in the list keep receiving it. Choosing a paid plan later resumes paused reports, oldest first, up to that plan’s limit.

If you subscribe during the trial, the trial ends and your new plan’s limits apply at once: if it allows fewer active reports than you are running, your newest reports beyond its limit are paused. We may limit trials to one per person or organization.

4.3 Automatic renewal

Starter, Pro and Venue are monthly subscriptions. They renew automatically every month at the price then in effect until you cancel. By subscribing, you authorize us to charge your payment method through our payment processor, Stripe, at the start of each monthly period. After you subscribe, we email you a confirmation with your plan, its price, your renewal date and how to cancel.

4.4 Failed payments

If a renewal payment fails, we email you and Stripe retries the charge several times. Your reports keep sending while the payment is being retried. If the payment has still not been made when the retries end, your account moves to the Free plan (or your trial, if one is still running) and we tell you: reports above its limit are paused, newest first, and the rest keep sending, within its recipient limit (section 4.2). Paying the outstanding invoice or choosing a plan in Dashboard > Billing resumes paused reports, oldest first, up to your plan’s limit.

4.5 Changing plans

You can switch between paid plans at any time in Dashboard > Billing. The new price applies at once, and a prorated charge or credit for the rest of the billing month appears on your next invoice. If the new plan allows fewer active reports than you have, your newest reports beyond the limit are paused. Recipients above the new plan’s per-report limit stay on the report but are not sent to until you choose a plan that allows them; the first ones in the list keep receiving it.

If you subscribed to a plan we no longer sell (marked “legacy” in your account), you keep it at its price and limits until you change plans or cancel, subject to section 4.1. Once you leave a legacy plan, you cannot choose it again.

4.6 Cancellation and refunds

You can cancel at any time in Dashboard > Billing. Cancellation takes effect at the end of the current paid month: you keep your plan until then and are not charged again. You can undo a cancellation before that date. When the paid period ends, your account moves to the Free plan and its limits apply (section 4.2).

Payments are not refundable, including for part of a month, except where the law requires a refund. If you delete your account, any subscription is canceled immediately and the unused part of the current month is not refunded.

5.Ticketing platform connections

To connect a ticketing account, you sign in with the platform and authorize TicketCounts.io. You confirm that you are allowed to share that account’s event and sales information with us and that your use of it follows the platform’s terms.

You can disconnect an account at any time in Dashboard > Integrations. Reports that use it are paused and resume when you reconnect the same account. If a platform revokes our access, changes its service, or stops returning counts for an event, the affected reports are paused and we tell you.

Eventbrite and Universe are trademarks of their owners. TicketCounts.io is an independent product and is not affiliated with or endorsed by them.

6.Report recipients and email

You choose who receives your reports. Only add people who expect them, such as your team, co-promoters, venues, artists and agents, and follow the laws that apply to the email you send.

By adding a recipient, you confirm that you have a legitimate business relationship with them, and you are responsible for honoring their requests about the reports you send them. Unsubscribes through the link in a report are handled automatically.

  • Each recipient gets their own copy, sent in your name (“Your organization via TicketCounts.io”). Replies go to your account email address.
  • Every report email has a “Stop these emails” link and one-click unsubscribe headers for mail apps.
  • When a recipient unsubscribes or marks a report as spam, we stop sending your reports to that address, and you cannot add it back. When an address bounces permanently, we stop sending to it until you correct or clear it.
  • Reports on the Free, Starter and legacy plans include a line saying they were sent via TicketCounts.io, with a link to our website. On Pro and Venue you can turn that line off for each report.

7.Acceptable use

You agree not to:

  • use the service for anything illegal, or to send reports to people who did not ask for them or have opted out;
  • send anything other than ticket-count reports through the service, or use it for advertising or bulk email;
  • connect a ticketing account you are not authorized to use, or break a connected platform’s terms;
  • try to get around plan limits, access other people’s accounts or data, or probe, scan or test our systems for weaknesses;
  • interfere with the service, overload it, or access it by automated means other than the features we provide;
  • copy, resell or rebrand the service, or reverse-engineer it except where the law allows;
  • upload malware, or content you do not have the right to use (including logos).

8.Your content and data

You keep ownership of what you bring to the service: your logos, organization name, report settings, recipient lists and the information from your connected accounts. You give us permission to host, copy and process it only to provide, secure and improve the service, and to show your logo and organization name in the reports you send. You confirm that you have the rights to the logos you upload.

How we handle personal information is described in our Privacy Policy. If you send us feedback or ideas, we may use them without any obligation to you.

9.Our intellectual property

The service, including its software, design, text and the TicketCounts.io name and logo, belongs to Elektronic Group Inc. and is protected by law. These terms give you the right to use the service while your account is open. They do not give you any other rights in it.

10.Third-party services

The service relies on other companies, including your ticketing platforms, Stripe for payments and our email and hosting providers (listed in our Privacy Policy). Payments are also subject to Stripe’s terms. We are not responsible for services we do not control, including their availability and the accuracy of the data they provide.

11.Availability and changes to the service

We work to keep the service available, but we do not promise that it will be uninterrupted or error-free. We may pause it for maintenance, security or reasons beyond our control.

We may add, change or remove features. If a change materially reduces a paid plan you are on, we will tell you at least 30 days before it takes effect, and you can cancel before then.

12.Suspension, cancellation and account deletion

We may suspend or close an account that breaks these terms, puts the service, other users or report recipients at risk, or that the law requires us to act on. Where it is reasonable, we will warn you first and give you a chance to fix the problem.

You can delete your account at any time in Dashboard > Account. Deleting it cancels any subscription at once, stops all reports, and removes your data as described in our Privacy Policy. After your account is closed, these continue to apply: section 4.6 (refunds), the feedback terms in section 8, section 9, and sections 13 to 18.

13.Disclaimers

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Ticket counts come from third-party platforms; we do not guarantee that they are complete, current or error-free, or that any report will be delivered at a particular time.

14.Limitation of liability

To the extent the law allows, Elektronic Group Inc. is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the service or these terms, even if we were told they were possible.

To the extent the law allows, our total liability for all claims related to the service or these terms is limited to the amount you paid us for the service in the 12 months before the event that gave rise to the claim.

Some places do not allow these limits, so some of them may not apply to you.

15.Indemnification

You will defend and indemnify Elektronic Group Inc. and its officers, employees and agents against claims, losses and costs (including reasonable legal fees) arising from your breach of these terms, the content you upload, the reports you send and to whom, or your breach of a connected platform’s terms or of the law.

16.Governing law and disputes

If you have a problem with the service, contact us first at support@elektronicgroup.com. We will try to resolve it informally within 30 days.

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Disputes that are not resolved informally will be decided by the state or federal courts located in Duval County, Florida. Nothing in this section limits rights you have under the consumer protection laws of the place where you live.

17.Changes to these terms

We may update these terms. The date at the top of this page shows the current version. For a material change, we will email account holders or show a notice in the app at least 30 days before it takes effect. If you do not agree with a change, cancel and delete your account before it takes effect; if you keep using the service after that, the new terms apply.

18.General

  • These terms and our Privacy Policy are the whole agreement between you and us about the service.
  • If a court finds part of these terms unenforceable, the rest stays in effect.
  • If we do not enforce a right, we have not waived it.
  • You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of the business, and will tell you if we do.
  • Neither of us is responsible for delays or failures caused by events beyond reasonable control.
  • We send notices to your account email address. You can send notices to us at support@elektronicgroup.com.
